Austria is an EU member state and a Convention party. Between EU member states, civil-status documents – and police certificates of a citizen’s own member state – need no apostille (Regulation 2016/1191); the multilingual standard form replaces a translation. For documents from outside the EU, and for diplomas, notarial deeds, court and company documents, the apostille of the issuing country is required.
Austrian apostilles on court and notarial documents are issued by the Landesgerichte; administrative documents are apostilled by the Federal Ministry for European and International Affairs or other designated authorities. Frequently apostilled Austrian documents include civil-status certificates, the Strafregisterbescheinigung, notarial deeds and Firmenbuch extracts.
Between EU member states, Regulation (EU) 2016/1191 exempts civil-status and similar public documents from the apostille, and some bilateral treaties (for example with Germany) go further. Documents from outside the EU need the apostille of the issuing country. Austrian authorities usually require German translations by a court-certified translator (allgemein beeideter und gerichtlich zertifizierter Dolmetscher). Typical uses are the Red-White-Red Card and other residence titles, family reunification, marriage, recognition or nostrification of degrees, and company formation.
Austria has objected to the accession of several states, including Pakistan, Bangladesh, Vietnam, Uzbekistan, Kyrgyzstan, Tajikistan, Mongolia, Algeria, Tunisia, Senegal, Burundi and Kosovo. Between Austria and these states the apostille does not apply and documents need consular legalisation.
Notaryzer handles it end to end: the notary reviews your application, we organise the apostille or legalisation in the issuing country, arrange the translation and ship the result to you or directly to the recipient in Austria.
- EU civil-status documents: ask for the multilingual standard form instead of an apostille
- Use a court-certified translator (gerichtlich beeideter Dolmetscher) for German translations
- From a state Austria has objected to? Plan consular legalisation, not an apostille
