A power of attorney is a private document. To be recognised abroad it first needs a notary: the notary certifies that the signature is yours or notarises the entire deed. Only then can the designated authority of that country attach the apostille – the apostille always certifies the notary, never the private signature directly. In the US that means a notary public and the Secretary of State; in Germany a Notar and the Landgericht; in Spain a notario and the notarial college; in Türkiye a noter and the kaymakamlık.

In most civil-law countries the signature must be given in front of the notary; some countries and many US states allow remote online notarisation. We prepare the text – bilingually or in the target language – book a notary near you, and handle the apostille and the sworn translation afterwards.

Because most foreign recipients have fixed expectations (Turkish land registries, Russian and Ukrainian notaries, Brazilian consulates, Spanish registries), we check the wording of the power of attorney against the recipient’s requirements before the notary appointment.

Between EU member states: Not covered by Regulation (EU) 2016/1191. Some bilateral treaties (Germany with France, Italy, Belgium, Austria, Luxembourg, Greece) remove the apostille requirement.

Also known as: Vollmacht (DE) · procuration (FR) · poder notarial (ES) · procura (IT) · procuração (PT) · vekâletname (TR) · pełnomocnictwo (PL) · volmacht (NL)

In most countries yes – the notary must witness your signature and identify you. Remote online notarisation exists in many US states, Estonia and a few others, and Austrian notaries offer video certification for documents used abroad. We book the appointment; the signing itself takes ten minutes.

Yes. Notaries in most countries certify signatures on documents in any language, as long as they can identify the document type. We prepare bilingual texts so that both the notary and the foreign recipient can read them.

The authority responsible for notarial documents in the notary’s country – the Landgericht in Germany, the Secretary of State in the US, the notarial college in Spain, the prefecture or procura in Italy. In some US states the county clerk must authenticate the notary first.

Some recipients (Türkiye, Russia, Latin America) want the sworn translator’s signature certified and apostilled as well. We know the countries where this is standard and include it.
