United States has applied the Hague Apostille Convention since October 15, 1981. Public documents from other Convention countries – civil-status certificates, diplomas, police certificates, notarial deeds, court decisions and company documents – are accepted in United States with an apostille from the issuing country, unless an Article 12 objection is in force between the two states. No embassy or consular step is required.

There is no single US apostille office. State documents – birth and marriage certificates, notarised documents, state court records, company filings – are apostilled by the Secretary of State (or equivalent office) of the issuing state; some states, such as New York, first require a county clerk certification of the notary. Federal documents, including the FBI Identity History Summary and documents signed by federal officials, are apostilled by the US Department of State. Some states also issue electronic apostilles.

For foreign documents used in the US, each recipient sets its own rules. USCIS follows the State Department’s country-by-country guidance and requires a full English translation with the translator’s certification of competence; courts, universities, licensing boards and county recorders may ask for an apostille, a certified translation or a credential evaluation. Typical cases are immigrant and work visas, professional licensing for doctors, nurses and engineers, company formation and banking for foreign founders, real-estate powers of attorney and probate.

The United States is among the states that objected to Kosovo’s accession, so apostilles do not operate between the US and Kosovo; legalisation applies there.

Notaryzer handles it end to end: the notary reviews your application, we organise the apostille or legalisation in the issuing country, arrange the translation and ship the result to you or directly to the recipient in United States.

  • Documents in another language: add a full English translation with the translator’s certification
  • Powers of attorney for US real estate: check the county recorder’s formatting rules before signing
  • FBI background checks are apostilled by the US Department of State, not by a Secretary of State
